Subject: First degree burn injury
Question: One week ago, three of my other employees as well as myself were at a restaurant for lunch. The waitress brought our meals to the table and dropped a hot plate with a hot oil sauce on my left arm causing a serious first degree burn. Can I receive compensation for this? I had to go to the emergency room for treatment.
Answer: Your post doesn't indicate what state you are in. I am an attorney in Florida, and the answer to your question under the Florida premises liability injury laws would be - yes.
The amount of the compensation would be based upon the severity of the burn, the amount of your medical bills, and whether any permanent scarring is left. Also, if you lose time from work, you could include your lost wages as part of a Florida premises liability injury claim.
You should speak with an experienced accident attorney in your area as soon as possible. There are many steps you should take now, i.e. notify the restaurant of the claim, get the restaurant's insurance information, take photographs of the burn, etc., so you can present the claim at the appropriate time.
Most accident attorneys handle cases like this on a contingent basis, which means you do not owe attorney's fees if there is no recovery. They will also offer a free initial consultation. So, you really have nothing to lose to at least sit down with a lawyer to discuss the claim.
Burn injuries tend to go away over time so make sure you get some good photos of the injury.
